1. Acceptance of Terms
By creating an account or using DMFlare (a service by Spirit Edutech Private Limited), you agree to these Terms of Service. If you do not agree, you may not use the platform.
2. Description of Service
DMFlare provides social media direct message automation tools for Instagram, WhatsApp, and other platforms. Features include automated DM replies, lead capture, analytics, and broadcast messaging.
3. Eligibility
- You must be at least 18 years old to use DMFlare
- You must have authority to bind the entity you represent
- You must comply with all applicable laws and platform policies
4. Your Account
- You are responsible for maintaining the security of your account credentials
- You must not share your account with unauthorized parties
- You must notify us immediately of any unauthorized access
- We may suspend or terminate accounts that violate these terms
5. Acceptable Use
You agree NOT to use DMFlare to:
- Send spam or unsolicited bulk messages
- Violate Meta's Platform Terms, Instagram API Terms, or WhatsApp Business Policy
- Harass, abuse, or threaten others
- Distribute malware, phishing links, or harmful content
- Circumvent rate limits or security measures
- Collect personal data without proper consent
- Impersonate others or misrepresent your identity
6. Platform Compliance
DMFlare operates within Meta's API ecosystem. You must comply with:
- Instagram Platform Policy: 24-hour messaging window, no promotional content in certain message types
- WhatsApp Business Policy: Template messages must be pre-approved by Meta
- CAN-SPAM Act: All automated messages must include an opt-out mechanism
7. Pricing & Billing
- Free tier: 500 DMs/month, 1 Instagram account
- Paid plans are billed monthly or annually via Razorpay
- All prices are in Indian Rupees (INR) unless otherwise stated
- Refunds are available within 7 days of purchase if you are unsatisfied
- We reserve the right to change pricing with 30 days notice
8. Data Ownership
- You own all content you create and data you upload
- We have a limited license to process your data solely to provide the service
- You can export all your data at any time via Settings → Compliance → Export
- You can permanently delete your account and all data via Settings → Compliance → Purge
9. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party services (Meta API, Razorpay, etc.).
10. Limitation of Liability
DMFlare is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees you paid in the preceding 12 months.
11. Termination
Either party may terminate at any time. Upon termination, your data is retained for 30 days, after which it is permanently deleted unless you request earlier deletion.
12. Governing Law
These terms are governed by the laws of India. Any disputes shall be resolved in the courts of Kota, Rajasthan, India.
13. Changes to Terms
We may update these terms with 30 days notice via email. Continued use after changes constitutes acceptance.
